upon him, and they entered the polytheists debt then obeyed them from all
sides, and became the matter of these rulers answering and their sects it is
known a necessity, and is not ignorant it except from the obliteration of
its insight Allah, and the ignorance of the monotheism truth that sent by it
the prophets from Adam to Mohamed peace be upon him, and not was the devil
and its followers and its soldiers and its man it establishes at all times
from the similarity what turns by it the people about the monotheism truth,
and it dresses the association of partners truth until it puts them in it,
some of them have spoken and claimed that an excommunication changer of the

disbelief judgements, then if he repents before he isolates, showing of the
regret, and taking the people call did not is accepted his repentance, and
if he was after the isolation or by the thing of his prevention that did not
come, and who prayed behind him a fear he returned the noon four, then he
does not stay if the exit enables him, and no excuse for him with the
abundance of sons and no other .
Then Eyad said : Abu Mohamed Al Kbrani : from Kairouan, asked about from
Ebeid's sons forced him into the entrance in their call or he is killed
؟ he said : he chooses the killing, and he does not excuse by this one
of except who their first entrance was the country before he knows their
matter, and as for till now the escape has become necessary, and with the
fear after his establishment because the position in the place of is
requested one of his family do not excuse the hindrance of the sharia that
does not become permissible, but he stayed in it from the scientists and the
worshippers on the difference of them, their enemy is alone with the Muslims
then tempt them from their religion .
Eyad said : and on this he was Gabala Bin Hammoud and his counterparts :
Rabih Al Katan, and Abul Fadl Al Hommosi, and Marawan Ibn Nsroun, and Al
Sbay, Walgbinani, they say and give a fatwa .
Youssef Bin Abdullah Alrraeny in his book said : Kairouan scientists agreed
unanimously, Abu Mohamed Bin Abu Zeid, and Abul Hassan Al Qabesi, and Abul
Qasem Bin Shalboun, and Abu Ali Bin Khaldoun, and Abu Mohamed Al Tbiqi, and
Abu Bakr virginity son : son state is Ebeid the state of apostates and

Abul Qasem Al Dhani said : and they are with the disagreement of the

As for Aloubayden's disbelief then he :

they deluded the people with the prophethood of the tyrant when they said :
oh Allah prayed .

Interests from the fatwa :
1 ـ the residence in a land does not become permissible in it the
sharia broke down, Ila if they departed the Al Matlin Wbaenouhm and taught
the people their religion, look saying an Al Kbrani : and does not excuse

The Kairouani Ibn Abu Zeid fatwa looks in Tripoli people at the end of the
fatwa, and what Kairouan scientists said : and does not excuse with the
compulsion on the entrance into their doctrine with the disagreement of all
disbelief kinds, because he stayed after his knowledge of their disbelief
one of then that does not become permissible to him, but he chooses the
killing without entering the disbelief . On this opinion Sahnoun's friends (
from the figures of an owner doctrine ) they give a fatwa Al Mslmsn .
3 excuse ـ with the ignorance : saying an Al Kbrani : and does not
excuse by this one of except who their first entrance was the country before
it knows its matter .
4 ـ do not excuse the person with the abundance of the sons and no
other, acted going the function and the loss of the position and going the
money . And Aldawedy said : and no excuse of him with the abundance of sons
and other .
5 repentance ـ its young man is the non regret and in it the charge of
love and desire was does not coming . Aldawedy said : then if he repented -
oh of the speakers or the judge or the mufti or the minister of religious
endowments - before he isolates showing of the regret, and is NOT accepted
his repentance, and if he was after the isolation or by the thing of his
prevention that did not come .
6 ـ are the non permissibility of the prayer behind the speakers of
tyrants and entrants in their religion and their regimes .
Aldawedy said : and who prayed behind him a fear - any of the Friday Prayers

these fatwas but the only preserved he is the remembrance ( the Book and the
Sunna ), then on us that we resort to them, no by except them . And from
examples this he came some of the scientists accused of atheism the hajjis,
and said that he died in the tyrant debt not in the Allah's religion that
rose .
And some of the scientists are the Ottoman Empire hamlet . And an
investigation this it extends, and she does not remember in the scientists
books except by way of the taming, and is not with being independent
evidences, then to the person avoids his Lord and so that he adheres to his
monotheism of the teethes .
Important tails on the fatwa and the envelope :
1 - Imam Al-Dhahabi translated in his book Al Mata ( the nobles figures
biographies ) in the seventh part p. of 148 under the name of - the martyr -
