First : the legitimate means for the change of the corruption ongoing in our countries

قال أبو عمر: وإذا صح وثبت أن العالم يزل ويخطئ لم يجز لأحد أن يفتي ويدين بقول لا يعرف وجهه". اهـ [إعلام الموقعين: 2/173 – 175].

لقوله صلى الله عليه وسلم: «من عمل عملا ليس عليه أمرنا فهو رد» رواه مسلم (فهو رد) أي مردود لا يعمل به.
ونقل الشاطبي رحمه الله طرفا من كلام أبي عمر بن عبد البر - الذي نقله ابن القيم - ثم قال الشاطبي: "إذا ثبت هذا فلابد من النظر في أمور تبنى على هذا الأصل, (منها) أن زلة العالم لا يصح اعتمادها من جهة ولا الأخذ بها تقليدا له، وذلك لأنها موضوعة على المخالفة للشرع، ولذلك عدت زلة، وإلا فلو كانت معتدا بها لم يجعل لها هذه الرتبة، ولا نسب إلى صاحبها الزلل فيها، كما أنه لا ينبغي أن ينسب صاحبها إلى التقصير ولا أن يشنع عليه بها، ولا ينتقص من أجلها، أو يعتقد فيه الإقدام على المخالفة بحتا، فإن هذا كله خلاف ما تقضي رتبته في الدين، وقد تقدم من كلام معاذ بن جبل وغيره ما يرشد إلى هذا المعني.


(ومنها) أنه لا يصح اعتمادها خلافا في المسائل الشرعية، لأنها لم تصدر في الحقيقة عن اجتهاد، ولا هي من مسائل الاجتهاد، وإن حصل من صاحبها اجتهاد فهو لم يصادف فيه محلا، فصارت في نسبتها إلى الشرع كأقوال غير المجتهد, وإنما يعد في الخلاف الأقوال الصادرة عن أدلة معتبرة في الشريعة، كانت مما يقوي أو يضعف. وأما إذا صدرت عن مجرد خفاء الدليل أو عدم مصادفته فلا. فلذلك إنه لا يصح أن يعتد بها في الخلاف، كما لم يعتد السلف الصالح بالخلاف في مسألة ربا الفضل، والمتعة، ومحاشي النساء، وأشباهها من المسائل التي خفيت فيها الأدلة على من خالف فيها". اهـ [الموافقات للشاطبي 4/170 – 172].


قال البخاري رحمه الله - في كتاب الاعتصام من صحيحه -: "باب إذا اجتهد العامل - أو الحاكم - فأخطأ خلاف الرسول صلى الله عليه وسلم من غير علم فحكمه مردود، لقول النبي صلى الله عليه وسلم «من عمل عملا ليس عليه أمرنا فهو رد»". [فتح
